Short Sale Avoid Foreclosure Advice written By Joe Kendall, Broker Associate with Sandals Realty. The Hardship Letter is the most important and is a major factor in getting your short sale approved by your lender along with your  documentation supporting this letter. ( I can go over this when we talk in Person)

 

I would like to give you some tips in how to write a hardship letter to your mortgage lender greatly improving your chances of the bank understanding your own personal situation.

 

Remember you are composing the "hardship letter" for your bank or your mortgage servicing company, do not write a book because most likely it will not get the attention your trying to receive from the lender. The person that is going to read this is someone that understands general information that is factual.

 

Please Keep it to one page (Do Not Type It , but write it out with an ink pen or print the letter out in ink, again Do Not Type This Letter !) be right to the point, put the emotional aspect  in the beginning and in the closing your message.

 

Here is an example list of hardships that lenders consider:

 

        Illness  (explain before and after effects)

 

  • Loss of Job ( what income you made before and now current, explain in the unknown future if it's unclear. 
  • Reduced Income (what you made before and what is now current )
  • Failed Business   ( how much was invested, how much money was lost and how this has impacted you currently)
  • Job Relocation ( forced to relocate ( current mortgage payment and what your new mortgage payment will be in our new location ) show your current income can not support two homes in a simple math problem)
  • Death of Spouse or C0-Borrower
  • Death (supporting documents )
  • Divorce (support documents )
  • Marital Separation (how this has impacted your ability to pay all your current bills )  
  • Reduced Income (what was it before and now )
  • Medical Bills   List all the bills current and future balance , list how much money you are currently behind)
  • Damage to Property (natural disaster or unnatural)

Now that you understand what your lender or servicer is looking for, it’s time to sit down and write a hardship letter. . Make sure you make it unique to your personal situation. Do not talk about local or national media issues, make it very personal coming from your heart.

 

 Remember that your hardship letter is a very important part of the workout process.

 To Whom It May Concern:

 

 I am writing this letter to explain my/our unfortunate set of circumstances that have caused us to become behind in our obligation to maintain our current mortgage payments . We have done everything in our power to make ends meat but unfortunately we have fallen so far behind that it looks very bleak so we are asking for your help. (ADD YOUR PERSONAL, EMOTIONAL FEELINGS HERE )

 

We would like you to consider working with us to modify our loan or doing a bank short sale. Our number one goal is  to keep our home and we now have come to conclusion our dream home and all we have worked for our in-tire lives is coming to end end and we have to come to terms with this. Please understand it's very hard and we did not ask for ourselves to be in this situation we are in today.

 

 The main reason that caused us to be so far behind is ( insert the No 1 reason here and be to the point   ) Soon after being late and our income not being no where near enough, we had fallen further and further behind. It’s now to the point where we cannot continue to catch up or pay what is owed to you. It has always been in the past and up to now,  to fully meet our monthly obligations to pay what we owe and stay current. But at this time we have exhausted all of our income and resources so we are asking for your helP

 

(The approximate date start of the hardship, we believe that our situation is ? on future timetable is ? )

  

Our situation has got-ton worse because (reason here) and we feel that if you could rework our loan balance and mortgage payment or agree to do a short sale? We feel this  would benefit us and (the name of the lender here). We would appreciate if you can work with us to lower or delinquent amount owed and or payment so we can keep our home and also afford to make amends with your firm.

 

We truly hope that you will work with us and together we can get this settled so we all can both move on.

Bonita Springs Florida. Banks are in many times agreeable to a bank short sale verse allowing your home to go back to the bank in foreclosure.  I receive lots of questions and listen to statements from people owning homes here in Bonita Springs, Estero and through out southwest Florida. Here are examples of calls I received recently.

 

(1) I have tried talking to my Lender about a loan modification, but they are saying there is nothing they will do, other then ask me when will I be making my next mortgage payment? Whats next for me?

(2) I have an adjustable rate mortgage and it went up to where I can no longer afford the payments? What can I do to get them to change it?

(3) I owe more then $350,000 more the what the house is worth. What can I do to get the mortgage company to change it so I can afford to keep my home?    

(4) I want my mortgage company to give me loan modification and they told me know they can not do this? Why?

Over 85% of the home owners in Southwest Florida trying to do a Loan Modification end up avoiding a Foreclosure by the Short Sale. Because of their current mortgage holder unwillingness to work out a reasonable deal for the home owner. Check out more information here

Fort Myers* Bonita Springs* Naples* Chase Bank Incentives For Your Short Sale !

 

If you are thinking about a short sale and your original mortgage was with Washing Mutual and is now with Chase Bank, they are looking to remove those mortgages off their books and they may have the exit strategy you may be of interest to you?

Chase bank has been offering up to $30,000 cash at closing to people that are behind in their mortgage (underwater is a good term ) but you have to qualify. Yes you read this correctly up to $30,000 cash at closing and they will wave any future deficiency to you!

You will never owe then another dime again! Here is the catch:

(1) Home owners who initiated their mortgage with the now out of business Washington Mutual home loans are qualified.

(2) The home owner must truly be underwater. meaning their home is worth a lot less today then what is currently owed on the home.

(3) Your cash amount paid at closing is based on your size of your loan amount and what your currently owe them.

(4)  You must show you are under some type of hardship and no longer can afford your current mortgage payment.

I am not really sure how many Washington Mutual Loans where written in Southwest Florida, but it will be interesting to see if these big incentives have an impact of our real estate market in southwest Florida.

I have successfully closed short sales with JP Morgan/ Chase Bank. So if your decide or have questions about doing the short sale with Chase bank give me a call and I will help you with the process. I do not charge anything to the home owner my commission is paid by the lender at closing.

Naples Short Sales Information written by Joe Kendall Broker Associate with Sandals Realty. I have many happy clients that I have successfully closed their short sale using my Short Sale Service Program for many homes located in Cape Coral, Fort Myers, Bonita Springs and Lehigh Acres.  

I have been working and closing short sales since June of 2006. My team negotiates ( Loss Mitigation as it is called )  with the lenders and we do not charge a FEE for short selling your home. The bank pays our commission, There are some investors calling home owners that may ask you to sign over your deed are really not trying you short sale your home. It's always good to seek legal advice before listing and selling your home as a short sale.

Here is how to write a Hardship Letter to your lender it will also give some discription to what is considered a hardship by your lender. Here is a basic list of required documents for the short sale

Remember even if you walk away from your home, the bank can still go after you up to 10 years down the road for the full amount you owe.

The HAFA stands for the Home Affordable Foreclosure Assistance Program it's importance to you the home owner is best described as am program of helping borrowers and a great alternative for you then loosing your home to foreclosure.

A short sale or deed-in-lieu is a very smart move for both the lender and the borrower because the home will maintain it's value better when occupied, and the borrower gets to reduce their debt load. If you were not able to get your loan modified, this may be the best option for you since a foreclosure or bankruptcy can affect your credit for 7-10 years

 

The results of a successful bank short sale only restricts you from getting a mortgage from Fannie Mae or Freddy Mac for within 3 years. This too helps you restore your credit report a lot quicker then a foreclosure.

The Banks will try and direct you to one of their bank owned property Realtors, but any Experienced Agent that has successfully closed several short sales is your best choice to help you with closing your bank short sale contract.
